Hon. Ubandoma Laven PDP Candidate Frowns at Interim Order Against his Victory

Following an interim order obtained from the Plateau State High Court by the Chairman Langtang North local government chairman, Kparnim Nanloh over the judgement of the State Local Government Appeal Tribunal which quashed his victory as winner of the council poll conducted last year , the declared winner, Ubandoma Laven of People’s Democratic Party has raised a suspicion that the order was obtained in breach of the law.

The Chairman of the local government Nanloh had approached the Plateau State High Court asking for judicial review by way of an order of certiorari quashing the decision of the Plateau State Local Government Election Appeal Tribunal which declared the candidate of PDP winner of the election.

Apparently reacting to the interim order, Counsel to the PDP candidate, N.I Darong in a letter to the Registrar of the State High Court said from the date his clients were served with the enrolled order of the Court till date, no other process has been served his clients.

He posited that the lack of service on his clients with an Originating Motion and a Motion on Notice for injunction one week after the interim Orders were granted has caused his clients to wonder if the interim orders were not obtained in breach of the law because the law is settle that an interim order of injunction cannot be granted in the absence of a Motion on Notice.

The Counsel acting on behalf of his clients therefore demanded that from the time of receipt of the letter, motion on Notice based upon which interim injunction was granted as well as the Originating Summons should be served otherwise the clients have the right to pressure that the orders were obtained based on speculation and not on any material placed before the Court.

Plateau State Local Government Election Appeal Tribunal had declared the PDP Candidate Mr. Ubandoma Joshua Laven winner of the Council poll conducted last year and consequently directed the Plateau State Electoral Commission (PLASIEC) to issue him certificate of return.

Four weeks after the judgement was pronounced, the winner is still waiting in the wing while the the Chairman, Kparnim Nanloh had obtained interim injunction against the judgement
